User agreement between the user ('User', 'you') and Direct Holidays ('Direct Holidays', 'we', 'us'). Direct Holidays is a trading name of Thomas Cook Tour Operations Ltd. Please read these terms and conditions of use ('Terms and Conditions') before using the bigpicturedirect.com/co.uk website ('Site'). You consent to these Terms and Conditions when you use this Site, without qualification. If you disagree with any part of the Terms and Conditions, you may not use this Site in any way.

The information on this Site is directed solely at those who access this Site from the United Kingdom mainland. We are an English registered Company. Our business and the services we offer are governed by the applicable laws of England and Wales. Site User Obligations

You agree to be bound by the following obligations, including without limitation:

2. You warrant that all information you provide about yourself, anyone else and your holidays shall be true and accurate.

3. The Site must not be used for speculative, false or fraudulent reasons.

4. The transmission of threatening, defamatory, pornographic, political, or racist material or any material that is otherwise unlawful is expressly prohibited.

5. The Site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed or reproduced in any way by you, except that one copy of the information contained within the Site may be made for personal, non-commercial use.

6. Direct Holidays reserves the right to use all comments and reviews for future promotional and/or marketing purposes. Comments and reviews, along with reviewers name and county may also be published and/or used for promotional/marketing purposes.

7. Direct Holidays reserves the right to use all photos submitted to the site for publishing, promotional and marketing purposes.

8. Photos submitted to the site must be owned by the reviewer, not be copyrighted images and must not contain any indecent or inappropriate content.

9. Direct Holidays reserves the right to change, condense or delete any content on this Site that Direct Holidays deems in its sole discretion to breach any of these Terms and Conditions.

10.Direct Holidays reserves the right to remove or to refuse to post any submission for any reason and is not obliged to enter into any correspondence with you about any removal or refusal of a submission.

11.You acknowledge that you and not Direct Holidays are responsible for the contents of your submission.

By submitting any content to the Site you represent and warrant that:-

You are the sold author and owner of the intellectual property rights in such content;
All moral rights that you may have in such content have been voluntarily waived by you;
You will not submit any content that contains any computer viruses, worms or other potentially damaging computer programs or files; and
Use of the content you submit does not violate these Terms and Conditions and will not cause loss, damage or injury to any person or entity.
You agree to indemnify and hold Direct Holidays and its directors, officers, employees and agents harmless from all claims, demands, loss, damage and costs of very kind and nature, including reasonable legal costs, arising out of your breach of any of the representations and warranties you have given above or arising out of your acting unlawfully or against the rights of any third party.

For any content you submit you grant to Direct Holidays a perpetual, irrevocable, royalty-free, transferable right and licence to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All bookings and purchases made via this Site are subject to the applicable booking conditions that appear on the relevant holiday product pages and to the general information appearing in our current On-line brochure and product descriptions.

No warranties, promises and/or representations of any kind, express or implied, are given as to the accuracy of any of the information contained on this Site or as to the nature, standard, suitability or otherwise of any services offered by us or on our behalf. We shall not be liable for any loss or damage of whatever nature (direct, indirect, consequential or other) which may arise as a result, directly or indirectly, from the use of any of the information or material contained in this Site and/or use of or access to any other information or material via web links from this site or any inability to access or use this Site. These exclusions of liability apply only to the extent permitted by law and, except for information or material accessed via Sites or supplied by an identified Third Party, where consistent with our applicable booking conditions.
